DMCA Policy

This DMCA Policy outlines the process OnvoLabs LTD ("OnVo", "we", "us", or "our") follows in compliance with the Digital Millennium Copyright Act of 1998 ("DMCA"). OnVo respects the intellectual property rights of others and expects our users to do the same. This policy is intended to facilitate the identification and removal of infringing material and content available through our services to protect the intellectual property rights of others.
1) Notification of Infringement
To file a notice of infringement with us, you must provide a written communication that sets forth the items specified below.
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
- Identification of the content that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the content.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the content in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

2) Procedure Following Receipt of DMCA Notice
Upon receipt of a valid DMCA notice as outlined in Section 1 of this policy, OnVo will take the following steps to comply with the DMCA requirements:
- OnVo will promptly review the notice to ensure it contains all the necessary information as specified herein. If the notice is found to be incomplete or invalid, OnVo reserves the right to disregard it.
- If the notice is deemed valid, OnVo will act expeditiously to remove or disable access to the content that is claimed to be infringing. The specific content identified in the notice will be addressed, and OnVo will take reasonable steps to prevent the infringing content from being accessible through its service.
- After removing or disabling access to the content, OnVo will make a reasonable effort to notify the user who posted the content that it has been taken down. This notification will include information about the notice and the possibility of submitting a counter-notification if the user believes the content was removed or disabled by mistake or misidentification.
3) Counter-Notification
If you believe that your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner’s agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notification containing the following information to [email protected].
- Your physical or electronic signature.
- Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification of the content to be removed or disabled.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which OnVo's address is located, and that you will accept service of process from the person who provided notification under Section 1 or an agent of such person.
Upon receiving a valid counter-notification, OnVo will promptly provide the person who provided the original infringement notification with a copy of the counter-notification, and inform that person that OnVo will replace the removed content or cease disabling access to it in 10 business days. Unless we first receive notice from the original complainant that such complainant has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the content on OnVo's service, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at OnVo's discretion.
4) Repeat Infringers. OnVo reserves the right to terminate the accounts of users who repeatedly infringe upon the copyrights of others.
5) Changes. OnVo reserves the right to modify the contents of this policy at any time. Your continued use of the service following the posting of changes to this policy will mean you accept those changes.
